All intellectual property rights in the Service, including but not limited to the software, design, graphics, logos, text, and compilation of content, are owned by or licensed to Klicktreff. Nothing in these Terms grants you any right to use our intellectual property except to the limited extent necessary to use the Service as intended.
By posting User Content on Klicktreff, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable licence to host, store, display, reproduce, modify (for formatting purposes), distribute, and make available your User Content solely for the purpose of operating and providing the Service. This licence ends when you delete your content or your account (subject to our retention policy).
You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe any third-party rights.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE.
We do not guarantee that: (a) the Service will meet your specific requirements; (b) the Service will be available at all times without interruption, delay, or error; (c) any match recommendations will result in compatible relationships; or (d) other users are who they claim to be.
Klicktreff is a platform for connecting people. We are not responsible for the conduct of any user, whether online or offline. Meeting other users in person carries inherent risks. Please review our Safety Tips before arranging any in-person meetings.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KLICKTREFF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
Our aggregate liability to you for all claims arising from your use of the Service shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) €100.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
These Terms are governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Germany.
If you are a consumer resident in the EU, you may also benefit from mandatory provisions of the consumer protection laws of your country of residence, and you may submit disputes to the EU Online Dispute Resolution platform at ec.europa.eu/odr.
We reserve the right to modify these Terms at any time. When we make material changes, we will provide at least 30 days' advance notice by email and/or a prominent notice on the platform. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
